It’s legal. And it’s shaking up how India handles undocumented immigrants. The Calcutta High Court isn’t saying people shouldn’t be checked. It’s saying suspicion ≠ proof. And detention without due process? That’s unconstitutional; even for foreigners. The court made it clear: Family statements don’t prove nationality. Paperwork alone isn’t enough. And you can’t deport someone while their case is still being heard. This matters because India’s new Immigration and Foreigners Act, 2025, replaced the old 1946 law; but didn’t erase constitutional rights. Article 21 protects *every* person, citizen or not, from arbitrary detention. So while the state can investigate and restrict movement, indefinite detention? That’s a bridge too far. The bigger message: Even when tackling complex immigration issues, the law must respect basic fairness. Otherwise, you’re not enforcing order; you’re creating chaos.
