Just days after the government quietly imposed Merchant Discount Rate (MDR) charges on UPI payments over ₹2,000, lawyers are challenging it as unconstitutional. The court didn’t stop it; yet; but demanded RBI explain: Is this a tax? A fee? Or just a commercial settlement? Here’s the twist: RBI says it’s NOT a tax or fee collected by the government. It’s a charge paid between banks and payment platforms; but merchants are still bearing the cost. The court is suspicious. Justice Bagchi asked: “What service is being rendered to justify this?” If it’s a fee, it needs Parliament’s okay; not just an RBI circular. And here’s what you need to know: Over 96% of users won’t feel it. But for the tiny 4% who do; the cap is ₹300 per merchant, no matter how big the transaction. Still, many small vendors say they’re already refusing UPI to avoid losing money. The real question isn’t just about money; it’s about power. Can the government sneak in charges through backdoor rules? The Supreme Court is now forcing RBI to spell out the rules; clearly. This isn’t about UPI dying.
