No problem; the Act still lets them lock you up for 2–10 years. The Court tore into this, saying it’s like punishing someone for being labeled a criminal; not for actually committing a crime. Here’s the scary part: there’s no real trial, no real appeal, no real safeguard. The Executive (read: the cops + the govt) gets to decide who’s a gangster; and once you’re on that list, even acquittal doesn’t save you. This matters for every aspirant, every citizen. Because if a law can brand you a criminal without an offence, what’s stopping it from happening to someone else; maybe you? The Court didn’t strike down the law; but they made it clear: it’s dangerous, arbitrary, and ripe for abuse. And that’s the kind of warning we shouldn’t ignore.
